Fortius Financial Advisors, LLC and Gary E. Oliver
Have you lost money with investment advisor Gary E. Oliver from Salt Lake City, Utah? We are investigating allegations made by the Securities and Exchange Commission (SEC) against Gary E. Oliver, the advisory firm that he previously worked for (Fortius Financial Advisors), and Fortius’ founder and former Chief Compliance Officer, Jeff Bollinger. Oliver was barred from the securities industry by the SEC for allegations made in the SEC’s complaint again him.
According to the SEC’s complaint, Fortius Financial Advisors engaged in a number of alleged securities violations, including that it invested $800,000 of one of its client’s money in an illiquid, unsuitable private fund that it managed called the Fortius Private Fund. It was also alleged that Oliver misappropriated more than $137,000 from a customer. The SEC also alleged that Fortius and Jeff Bollinger failed to reasonably supervise Oliver’s conduct.
The SEC punished those involved in several ways. Gary Oliver was barred from the securities industry, and he was also ordered to pay disgorgement of over $138,000, a civil penalty of $125,000, and interest of $15,426. Fortius Financial was ordered to pay a civil penalty of $70,000 and disgorgement of $20,749, with $3,321 in interest. Bollinger was ordered to pay a civil penalty of $25,000 and disgorgement of $1,718, plus $252 in interest.
