In particular, he tried to get two customer complaints removed from BrokerCheck, including one complaint that settled for $325,000 (paid solely by Underhill’s former brokerage firm, Voya Financial Advisors). The customer complaints involved sales of private placements and a real estate investment trust (REIT) called Northstar Healthcare Income. An arbitrator denied Underhill’s request to remove the complaints from BrokerCheck.
James Underhill was a registered representative of Voya Financial Advisors from 2004 to July 2020. He has also been licensed with SagePoint Financial from July 2020 to the present. He has worked at branch offices in Tucson, Arizona.
Brokerage firms like Voya Financial Advisors have a responsibility to adequately supervise all representatives who are registered through their firm. Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies.
